A major shake up of the laws against dog fouling resulted in the Dogs (Fouling of Land) Act 1996 which replaced the cumbersome system which previously existed.
In September 1997 Fareham Borough Council adopted the new Act to assist in achieving our aim of making Fareham a cleaner and more environmentally friendly place to live. This piece of legislation enables the majority of land within the boundaries of Fareham Borough to be designated as a 'clean up after your dog' area.
Private gardens, drives etc are not covered by the legislation as they are not for general public access
Any person in charge of a dog who does not clean up at the time the dog has defecated will be issued with a Fixed Penalty Notice which carries a fine of £75.00. The notice must be paid to Fareham Borough Council within 14 days or, alternatively, the offender may be prosecuted.
Offenders also have the option to be dealt with by a Magistrates' Court facing prosecution and a maximum penalty of £1000.00 if found guilty.
The enforcement of this piece of legislation goes a long way to ensuring that areas of recreation and places where the general public have access are kept clear of dog fouling.
By-laws which cover dogs having to be on a lead in areas such as walkways adjacent to the highway, and not being allowed on the beach at Hill Head between May and September are still current. If these by-laws are contravened, offenders may be prosecuted.
