What are the Legal Requirements for a Hackney Carriage Vehicle Licence

 

There are many different laws affecting proprietors and vehicles but the main Acts of Parliament covering the licensing of Hackney Carriage Vehicles are:

  • The Town Police Clauses Act 1847
  • Part II of the Local Government (Miscellaneous Provisions) Act 1976
  • The Transport Act 1985
  • The Disability Discrimination Act 1995 and 2000

These Acts give wide powers to impose conditions on the grant or renewal of vehicle licences and allow the Local Authority to make policy guidelines determining the design or appearance of the vehicle to make it identifiable as a hackney carriage.  These Acts also allow the Local Authority to limit the number of vehicles licensed in the borough if satisfied that ‘there is no significant demand for the services of Hackney Carriages which is unmet’. Currently Fareham Borough Council is ‘de-regulated’ and do not impose any quantity control.

 

Before we grant or renew any vehicle licences we must be satisfied that:-

  • Your car is of a suitable design and size and has the distinguishing marks to identify it as a taxi (see technical specifications).
  • That you are the legal owner of the vehicle.
  • Your car is mechanically suitable. The mechanical condition to be confirmed by a detailed inspection.
  • Your car is suitably insured for standing and plying for hire
  • Your car is constructed or adapted to seat no more than 8 passengers
  • You are responsible for the keeping and running of the vehicle and you have a home address or business address in the borough from which to run your licensed vehicle.
  • You have supplied the necessary information required to licence your vehicle.
  • It is a serious offence to provide false information to obtain your vehicle licence.
