Licensing

 

The information on these pages give details regarding the licensing of people and premises for a range of activities including sale and supply of alcohol, late night refreshment, regulated entertainment, taxis, lotteries, charitable collections, acupuncture, animal welfare, scrap metal dealers and motor salvage operators and new provisions regarding gambling premises as from 2007.

 

Animal Welfare

Cat Boarding – The Animal Boarding Establishments Act 1963 requires that premises for boarding cats must be licensed by the Local Authority.

 

Dangerous Wild Animals – The Dangerous Wild Animals Act 1976 states that licences are required from the Local Authority to keep certain animals specified in the Act.

 

Dog Boarding – The Animal Boarding Establishments Act 1963 requires that premises for boarding dogs must be licensed by the Local Authority.

 

Dog Breeding – The Breeding of Dogs Act 1973, as amended by the Breeding and Sale of Dogs (Welfare) Act 1999, requires that breeding premises must be licensed by the Local Authority.

 

Pet Shops – The Pet Animals Act 1951 requires that any shop that sells pets to be licensed by the Local Authority. A licence may also be required in other circumstances when animals are sold.  Animal may never be sold from a market stall or similar. 

 

Riding Establishments – The Riding Establishments Acts 1964 and 1970 require that if you provide riding lessons or hire out horses to be ridden for payment that you obtain a licence from the Local Authority in which the stables is situated.

 

Zoos – The Zoo Licensing Act 1982 requires that if you are proposing to open a zoo you must contact both the Local Authorities Health and Safety Department and the Department for the Environment, Food and Rural Affairs (DEFRA) on all aspect of zoo licensing.

 

Charitable Collections

House to House Collections – The House to House Collections Act 1939 and 1947 Amendment Act requires that any institution or individual wishing to carry out a collection from House to House must apply for a permit to the Local Authority, unless are a registered charity with the Charity Commission they are exempted. A minimum of 28 days notice is required for this type of permit.

 

Street Collections – Under S5 of the Police, Factories etc (Miscellaneous Provision Act 1916, as amended by S251 and Schedule 29 to the Local Government Act 1972 anyone wishing to make a collection for charity in the street must apply for a permit to the Local Authority, if the collection is to be made on private property i.e. within a shop then the permission of the shop owner must be forwarded with the permit application. A minimum of 28 days notice is required for this type of permit.

 

Gambling

Licensing Act 2003

 

 

Premises Licence – Under the Licensing Act 2003 anyone wishing to open a premises at which Alcohol is sold, Regulated Entertainment is to take place or where food is to be sold after 11.00pm is required to apply for a licence to permit these activities to take place.

 

Personal Licence – Under the Licensing Act 2003 if you wish to have a personal licence to sell alcohol or be named as a Designated Premises Supervisor of a premises you may apply to the Local Authority for the necessary application forms. Current Personal Licence Applications are available .

 

Temporary Event Notice – Under the Licensing Act 2003 if you wish to have an event at which Alcohol is sold, Regulated Entertainment takes place or where food is to be sold after 11.00pm but only for a limited period and for a limited number of people you may apply for a temporary event permit. Register of Temporary Events received under Licensing Act 2003.

 

Motor Salvage Operators

Motor Salvage Operators – Under the Vehicles (Crime) Act 2001 and the Motor Salvage Operators Regulations 2002 anyone wishing to carry on the business of salvaging parts from motor vehicles must register with the Local Authority in which the business is being carried run.

Scrap Metal Dealers

Scrap Metal Dealers – Under the Scrap Metal Dealers Act 1964 anyone wishing to carry on the business of scrap metal dealing must register with the Local Authority in which the business is being run.

 

Sex Establishments

Sex Shops – Under the Local Government (Miscellaneous Provisions) Act 1982 (control of sex establishments), anyone wishing to run a sex establishment must apply to the Local Authority for a licence to run such an establishment.

 

Skin Piercing (Acupuncture, Ear Piercing, Electrolysis, Tattooing)

Ear Piercing, Electrolysis and Skin Piercing – The Local Government (Miscellaneous Provisions) Act 1982 requires that all persons running a premises and/or carrying out the act of skin piercing must be registered with the Local Authority.

 

Taxi and Private Hire

Drivers – Under the Town Police Clauses Act 1947 and the Local Government (Miscellaneous Provisions) Act 1976, anyone wishing to drive a taxi or private hire vehicle in Fareham must apply to the Local Authority for the application forms.

 

Vehicles – Under the Town Police Clauses Act 1947 and the Local Government (Miscellaneous Provisions) Act 1976 when you have had your badge to drive issued you must apply to the Local Authority for a vehicle licence.

 

Operators – Under the Town Police Clauses Act 1947 and the Local Government (Miscellaneous Provisions) Act 1976 if you wish to run Private Hire Vehicles in Fareham, you must apply to the Local Authority for an Operators licence.
