In June 2010 Fareham Borough Council served planning enforcement notices on four chalets at the Solent Breezes Holiday Park site. These notices were issued as the four chalets were being occupied on an all year round basis contrary to planning restrictions imposed upon them.
Executive Leader for Fareham Borough Council, Councillor Seán Woodward, said: "Whilst the Council recognises that a small proportion of chalets at the site can lawfully be occupied all year round, the majority of the chalets cannot. Fareham Borough Council believes that this site which is some distance from employment, shopping, community and other facilities is not an appropriate location for permanent residential development. It is also important that the character of the site as one of a Holiday Park is retained."
On 15 February 2011, Fareham Borough Council received the planning appeal decision notices in respect of three of the chalets. The Planning Inspector decided that all three appeals should be upheld. The Council has since carefully considered the three planning appeal decisions and is concerned by the ultimate conclusions reached by the Planning Inspector and how he reached them. As a result Fareham Borough Council has lodged an application with the High Court seeking permission to challenge the three appeal decisions.
