CCTV Subject Access

If you wish to find out about what information, if any, is held about you on the CCTV system as provided for in section 7 of the Data Protection Act 1998 you will be required to make the request in writing on a Subject Access Request Form.

All requests for subject access will be dealt with by the CCTV Manager or a nominated deputy. A written response to the request will be provided within 40 days of receipt, either setting out the steps intended to be taken to comply with the request or setting out the reasons for refusing the request.

A fee of £10 will be levied.

The Office of Information Commissioner has issued a Code of Practice External Hyperlink for users of public area CCTV Systems. A copy of this may be obtained on application to the CCTV Manager.

The purpose of CCTV

The use of Closed Circuit Television (CCTV) shall be for the purpose of:

Recorded images

The CCTV system operates 24 hours per day every day of the year. Images from all of the cameras are recorded onto a digital recording system for a maximum of 30 days. After this period the images are overwritten. All requests for the retention of recorded images are considered against the provisions of the Data Protection Act.1998 and the CCTV Code of Practice. The storage, processing and use of recorded data obtained by the CCTV
System is guided by the following general principles:

Disclosure policy

Disclosure of data obtained by the CCTV System will only be permitted in accordance with the relevant legislation and the criteria contained within the Code of Practice.

In every case a written application in an approved format, clearly showing the reason(s) for the request, is required using the Subject Access Request Form.

The Code lists third parties from whom requests to view data will be regarded as primary requests and sets out the circumstances in which applications may be made. The third parties include:

The Police, Gosport Borough Council (specific nominated officers); Fareham Borough Council (specific nominated officers); Other statutory prosecuting
authorities (e.g. trading standards, Ministry of Defence Police, British transport Police etc; solicitors, plaintiffs/defendants and person exercising their right of subject access under the Data Protection Act 1998.
