Fly Tipping Prosecution Success

Fareham Borough Council is pleased to announce a successful fly tipping prosecution at Portsmouth Magistrates Court last week.

The waste was dumped illegally in Privett Road, Fareham in June 2023. Council Enforcement officers attended the scene where the waste was obstructing residential garages and had the potential to pose a risk of harm to residents.

The investigation found that the offender, Mr Smith, had been paid to collect and remove the waste from an unsuspecting customer in Fareham, and had then dumped it illegally.

Mr Smith pleaded guilty to the fly tipping offence and for collecting the waste without a valid license at Portsmouth Magistrates Court. The District Judge sentenced Mr Smith to a Community Order of 18 months, with a requirement of 150 hours of unpaid work. Mr Smith was also ordered to pay £1086.23 in costs, which included compensation to the Council for removing the fly tipped waste and to the victim who paid Mr Smith to remove it.

Executive Member for Health and Public Protection, Cllr Joanne Burton, said: “This is a great outcome for the Council, and we hope that it will act as a deterrent for others who may be tempted to offend. Fly tipping is unacceptable, and a blight on our beautiful Borough. This outcome is testament to the painstaking hard work of our officers. However, this is a task that should never have needed to be done and that is why we will do everything in our power to prosecute fly tipping offenders in Fareham.”
