Company prosecuted for failing to comply with planning conditions

Fareham Borough Council brought a successful prosecution at Portsmouth Magistrates recently, in relation to the breach of planning conditions attached to a planning permission.

Bishopsgate Property Rentals Limited pleaded guilty to the charges and was fined £1,668.00, including costs and a court surcharge.

Bishopsgate Property Rentals’ failed to comply with two planning conditions which required the provision of landscaping and ecological enhancements, in association with the construction of a new property at Lodge Road, Locks Heath.

Following unsuccessful attempts to resolve the matter informally with the developer, the Council served a formal breach of condition notice. The notice specified the date by which the planning conditions had to be complied with. The developer failed to comply with the conditions by the required date which led to Fareham Borough Council pursuing the matter through the Courts. 

Chairman of the Planning Committee at Fareham Borough Council, Cllr David Foot, commented: “I am pleased that the Courts treated this matter seriously and found the developer guilty of this planning breach. It is particularly vexing when developers, who should know better, do not adhere to planning conditions, and fail to put things right. The planning conditions were imposed to preserve the local environment and ensure wildlife was properly taken into account and the Council acted accordingly when the developer failed to comply with them.”
