Freedom of Information Act Policy
In responding to the Freedom of Information Act, the Borough Council will aim to demonstrate that it is an open organisation committed to delivering high quality public services.
The Council will also aim in complying with the Act and dealing with requests:
- To maintain a comprehensive Publication Scheme
(509 KB) that provides information which is readily accessible without the need for a formal Freedom of Information Act request.
- To protect the personal data that the Council holds and disclose it only in strict compliance with the provisions of the Data Protection Act 1998.
- To satisfy all formal Freedom of Information Act requests promptly and within 20 working days.
- If it is expected that this deadline cannot be met, to give advice as soon as possible of the reasons for the delay and when it is expected that either a decision will be made or the information will be supplied.

- To provide advice and assistance to enable requests for information to be made.
- To publish its procedures and assist those seeking information to clarify their requests so that they can obtain the information that they require.
- In applying the exemptions provided in the Freedom of Information Act, where qualified exemptions exist, to disclose information unless the balance of public interest lies in withholding it.
- To consult with third parties before disclosing information that could affect their rights and interests, while recognising that in accordance with the Act, the Council must take the final decision on disclosure.
- To charge for information requests in line with the Freedom of Information Act Fees Regulations or other applicable regulations, including the Data Protection Act 1998.
- To record Freedom of Information Act requests.
- To monitor its performance in handling such requests.
